What My Elf Moved is
My Elf Moved is an entertainment app. From a photo you take of a Christmas toy, it makes a short, playful AI video (a "story") that ends on your photo. Stories are make-believe for family fun, not real recordings of anything that happened. AI results vary: a story will not always look exactly like your toy, which is why every story has a free preview, an automatic refund if it fails and a free remake.
Who can use it
- The app and purchases are for adults (18 or over) only. Parents may of course share the finished stories with their children.
- Only use photos you took or have the right to use.
- Keep people out of your photos, especially children. Photos with people in them are not used.
Stories and credits
- Each phone gets one free story to try.
- Story packs and the Christmas Pack are one-off purchases of story credits. One credit makes one story. Nothing is a subscription and nothing renews.
- If a story fails to make or gets stuck, its credit is returned automatically.
- Each story includes one free remake if you are not happy with how your elf looks.
- Credits are for use in the app only, have no cash value and cannot be transferred to anyone else. You can move the stories you bought to a new phone of your own with the recovery code in the app's Settings. They do not expire while we run the app; if we ever close it, we will tell you in the app at least 30 days before.
- To keep the service fair for everyone, there are daily limits on how many stories one phone can make.
Payments and refunds
Purchases are made through the App Store or Google Play, which take the payment and show your local price. Refund requests for a purchase go to them: Apple at reportaproblem.apple.com, Google through your Google Play order history. If you ask Apple for a refund, we may tell Apple how many stories of that pack you used. Stories from a refunded purchase that are not used yet are taken back. If something went wrong with a story, tell us too and we will put it right. Nothing in these terms affects your rights under consumer law.
Your photos and your stories
Your photos stay yours. You let us and our AI providers use each photo only to make the preview and story you asked for; we then delete it from our server as described in our privacy notice. The stories we make for you are yours to keep and share for personal, non-commercial use.
Stories are made by AI (Google Gemini and Magnific with the Kling video model) and are marked as AI-made. Please do not remove that marking or present a story as a real recording.
Fair use
Please do not use My Elf Moved for anything unlawful, harmful, misleading or offensive, to upload photos of people (in particular children), sexual content, other people's personal information or content you have no right to, to make deceptive videos, or to try to break, overload or copy the service. We may refuse a photo or pause access if this happens.
By sending a photo you confirm that you took it or have the right to use it, and that you have permission from anyone or anything's owner shown in it (photos with people in them are not used). Because our AI providers make the videos, you also agree to follow Magnific's Terms of Use, AI Products Terms and Acceptable Use Policy, and Google's Generative AI Prohibited Use Policy. Where those are stricter than these terms, they apply to how you use the stories.
Availability
We work hard to keep the app and website running, especially in December, but we cannot promise they will always be available or that every story will be made within a set time. We may change or improve features.
Liability
We are responsible for loss that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable. Nothing here limits liability that cannot be limited by law.
Law
These terms are governed by the law of England and Wales. If you live elsewhere, you keep the protection of your local consumer law and may bring a claim where you live.
